Prince Harry and Meghan Markle may follow in the footsteps of former U.S. President Donald Trump by choosing to plead the Fifth Amendment if they are required to testify in Samantha Markle’s lawsuit against the Duchess of Sussex, according to Express.
The Fifth Amendment grants individuals the freedom to refuse to answer any questions and declare no comment.
Samantha, who is Meghan’s estranged half-sister, is suing her for comments made during an interview with Oprah Winfrey.
A U.S. court recently denied a state of discovery in a defamation action, which means that Meghan and Harry might be obligated to testify.
Prosecutor Nathaniel Mack expressed concerns that the deposition’s testimony could be seen as a form of torture, particularly for high-profile individuals like the royal couple.
He cited cases involving Governor Cuomo and President Trump, which involved lengthy depositions lasting 9 to 11 hours.
Regarding the Sussexes’ testimony, Mr. Mack stated that it would likely be limited in scope and review, providing few new details.
He explained that the Markle lawsuit is currently in the discovery stage, allowing both sides to request evidence and information in preparation for trial.
If the case continues, Samantha’s lawyers will question Meghan and Harry before July, as per the judge’s ruling.
Samantha initiated the lawsuit last year, seeking damages of £62,000 ($75,000) over Meghan’s claims in the Oprah interview and the couple’s unofficial 2020 biography, “Finding Freedom.”
She wants her half-sister to admit that she lied about their relationship and upbringing to sell a rags-to-royalty narrative.
Samantha also alleges that Meghan lied about being an only child and the last time they saw each other.
Mr. Mack emphasized that Samantha must provide evidence to substantiate her claims in accordance with United States federal law.
If the case survives dismissal, it will be interesting to see what evidence the Patent Office can introduce to support her claims.
So far, Meghan’s legal team has defended her freedom of speech under the First Amendment, asserting that Samantha’s criticism of Meghan’s comments falls within her fundamental rights.
Samantha’s lawyers have submitted nearly 40 questions to the court that they want answered, and a mediator has been appointed in the hopes of resolving the suit without a trial.
The outcome remains uncertain, and it is yet to be seen whether Prince Harry and Meghan Markle will invoke the Fifth Amendment or if Samantha will be able to uncover the truth in court.
